Not necessarily. So far, ESP is available only for Diamond DA42-VI and DA62 twins, not for the DA40NG. So with a DA40NG my understanding is that Phase 3 software will include the Level function without ESP.

Slight clarification: ESP functions whether or not the AP is on, but it can be disabled before flight via the AUX page. USP only kicks in if the AP is on. I've found it challenging to practice some maneuvers with ESP enabled and quickly learned that steep turns and stalls are much simpler if I hold the AP Disconnect red button down to override ESP.

Are the G1000 software upgrades listed for all the DA40 installs?

The Legacy upgrades are principally focused on the large fleet of Lycoming-powered DA40s with WAAS. That leaves out the DA40-TDI (aka DA40D) and DA40-180s that do not have WAAS.

The NXI "Phase III" upgrades apply to DA40s and DA40NGs that have the NXI Phase II hardware factory-installed or have participated in the NXI Phase 1 to Phase 2 upgrade program.

Nothing for owners to do right now except wait with anticipation until the updates are released. (The schedule targets are in the Diamond communication).

The software installation will require a trip to your Garmin or Diamond Service Center. The software update itself is free. Owners will need to pay their Garmin/Diamond service provider for their time to install and configure the software update -- estimated at around 2 hours, give or take.

To be perfectly clear, if your DA40-180 or DA42/TDI does not have WAAS, or you have NXi Phase I, you should contact Diamond to get on a list to upgrade your hardware so you can take full advantage of these software releases when they become available.

Chris, yes! Thank you - I accidentally included ESP (should only be USP) in the AP dependent modes. Well spotted - perhaps the mod could correct my post so someone doesn’t pick it up incorrectly.
