That's not been true in my experience. There are 3 possible GMA 1360 configurations for 3D audio: ON, USER, and OFF. Every NXi Phase II Diamond aircraft I've seen starts out configured with 3D audio set to OFF.
If it were set to USER, an AUX page menu item would be available on the MFD for the pilot and co-pilot to enable/disable 3D audio -- this is missing on all new Diamond aircraft that haven't been reconfigured.

When I first peeked at the settings in configuration mode in my new 42 it was set to USER. Oddly, I thought, it didn't allow this user to select 3D Audio until it was set to ON.
